Everything You Need to Know About the South African General Work Visa

Are you planning to build your career in the “Rainbow Nation”? South Africa remains a top destination for global professionals seeking vibrant culture and a growing economy. However, the immigration landscape has changed significantly in late 2024.

Whether you are an employer looking to hire international talent or a professional with a job offer, here is the definitive guide to the South African General Work Visa, featuring the newly introduced Points-Based System (PBS).

What is a General Work Visa?

The General Work Visa (Section 19(2) of the Immigration Act) is designed for foreign nationals who have a formal job offer from a South African employer but whose occupation does not fall under the “Critical Skills” list.

Historically, this was the most difficult visa to obtain due to the “Department of Labour” (DoL) certificate requirement. Exciting News: As of October 2024, the DoL certificate has been replaced by a streamlined Points-Based System, making the process faster and more transparent.

The New Points-Based System (PBS): How it Works

To qualify for a General Work Visa today, you must score a minimum of 100 points. This system evaluates your “worth” to the South African economy based on several key factors:

  1. Qualifications (NQF Levels):
    • NQF Level 9 or 10 (Master’s/PhD): 50 Points
    • NQF Level 7 or 8 (Bachelor’s/Honours): 30 Points
  2. Annual Gross Salary:
    • Above R976,194: 50 Points
    • Between R650,796 and R976,194: 20 Points
  3. Work Experience:
    • 10+ years of relevant experience: 30 Points
    • 5–10 years of experience: 20 Points
  4. Language Proficiency:
    • Fluency in one of the 11 official languages: 10 Points
  5. Trusted Employer Scheme:
    • If your employer is part of the “Trusted Employer Scheme”: 30 Points

Key Requirements & Documentation

While the points system simplifies the merit of your application, you still need to provide standard legal documentation:

  • SAQA Evaluation: Your foreign qualifications must be evaluated by the South African Qualifications Authority. Pro-tip: If your evaluation is still pending, you may be issued a 12-month conditional visa.
  • Employment Contract: A signed contract stating that your salary and benefits are not inferior to those of local citizens in similar roles.
  • Police Clearance: Certificates from every country you’ve lived in for 12+ months since age 18.
  • Medical & Radiology Reports: To confirm you are in good health.
  • Employer Undertakings: The employer must commit to informing Home Affairs if your employment ends and take responsibility for deportation costs if necessary.

Benefits of the General Work Visa

  1. Path to Permanent Residency: Once you have held a General Work Visa for 5 consecutive years, you are eligible to apply for Permanent Residence.
  2. Family Accompanying: Your spouse and dependent children can join you on “Relative Visas.” While your spouse cannot work on that specific visa, they can apply for their own work endorsement once in the country.
  3. Long-Term Validity: Typically issued for up to 5 years (or the duration of your contract), offering significant stability.

Processing Times & Renewals

With the removal of the Department of Labour requirement, processing times have dropped. You can generally expect an outcome within 8 to 12 weeks.

Renewal: You can renew your visa from within South Africa, provided you apply at least 60 days before your current visa expires.
